Sex Offender Arrested After Attempting to Sexually Assault Elementary Student

According to KTLA, a man hopped a fence before attempting to sexually assault a girl in the restroom inside McAuliffe Elementary School, located at 4100 Golden Ave, Riverside, CA 92505.

Authorities say 32-year-old Logan Nighswonger hopped the school fence and entered the building. A campus supervisor saw him come out of a restroom and could hear the 10-year-old girl crying inside. Nighswonger was able to hop back over the fence and get into a vehicle in the parking lot. Police apprehended him later in Placentia. Nighswonger is a registered sex offender, and the police have not released how he gained entry into the school building.

Can an Elementary School Be Liable for Sexual Assault?

Attorney contributor Jason Amala advocates for sex assault victims and their families in the state of California. Through his experience as a school sex abuse lawyer, he helps victims get the justice they deserve. Recently, Bobby highlighted information regarding who could be held liable for sexual assault on an elementary school campus.

"Elementary schools have a legal and moral commitment to provide children with a safe environment to learn and socialize. Schools must ensure their students are safe by implementing basic security measures. Surveillance cameras and on-site resource officers are just a couple of preventative steps to reduce the risk of dangers, such as sexual assault. In addition to vetting all school volunteers, it is imperative that all entryways be monitored. If the school officials neglect these basic safety procedures, they could be held liable in a civil lawsuit."

"If abuse occurs on an elementary school campus, an investigation is necessary to determine if the school's security was up to par. Unfortunately, many incidents occur due to security negligence. Victims and their families are urged to speak to an experienced school sexual abuse lawyer to determine their best legal actions. In cases of negligence, they may be eligible to pursue a lawsuit against the school district or officials."
