Attorney contributor Guy D'Andrea helps victims abused by teachers and coaches seek justice through civil lawsuits against negligent third parties. As an experienced school sexual abuse attorney, Brian offered to share some information on their legal options.
"Parents send their children to school with the intention that their wellbeing and safety is a top priority. High schools have a legal and moral responsibility to prioritize the safety of the students in their care. Sadly, sexual predators can take up positions within schools. These positions often include coaches and teachers in close contact with students. They gain the trust of these children and then exploit that trust to commit heinous crimes of sexual abuse."
"Schools can implement a safety plan that includes security cameras on the campus, patrolling resource officers, and repeating background checks on all staff. Failure to provide a level of preventative measures can cause a school to be deemed negligent. A reasonable security plan will help to reduce the risk of preventable crime, including sexual abuse."
"When a coach is accused of sexually abusing a student, it's essential to ask if the school could have prevented these crimes. These cases often only happen due to school officials' negligence, which may include ignoring reports of misconduct. If negligence is a factor in the sex abuse case, the victim may have grounds for a lawsuit. An experienced school sexual abuse attorney can guide victims through the legal process to get the compensation they deserve."
