Former Daycare Owner's Husband Charged With Raping a Child

According to Fox 45 News, 54-year-old Edward Biedenkapp has been accused of raping a child. Biedenkapp's wife ran the Biedenkapp Daycare located in Perry Hall, Maryland, from 2007 until 2011. 

The address of the daycare has not been released, but police fear that more children could have been abused by Mr. Eddie, as he was known by the children in his wife's care. One child has come forward with the allegations, and police urge anyone with ties to the daycare or Biedenkapp to reach out if they have any information on potential abuse.

Legal Rights of Victims Sexually Abused at a Day Care

Attorney Contributor Aaron Blank is a sexual abuse attorney who represents sexual abuse victims and their families in civil lawsuits. During a recent interview, Aaron shared his insight regarding the rights of victims sexually abused at a daycare

“Parents enroll their children with daycare providers under the impression their children are being kept safe during the day. In fact, daycare facilities have a legal duty to provide a safe atmosphere for the children in their care. However, too often across the country, reports emerge of staff and aides taking advantage of their positions of trust and power in order to sexually abuse children. These daycare providers should ensure they have adequate security measures in place to prevent this from occurring. A few examples can include conducting background checks on all staff and utilizing surveillance cameras that parents can access. If daycares fail to provide a certain level of security and abuse occurs, the daycare could be held responsible.”

“Victims and their families could have reasons to pursue a civil lawsuit against the daycare if the facility is deemed negligent. The family should inquire if the daycare did everything within its means to prevent sexual abuse from occurring. This includes reporting prior incidents of misconduct. Ultimately, if a daycare did not provide sufficient security measures or ignored previous misconduct incidents, the facility could be considered negligent and liable for crimes within its facility. In cases of negligence, it is highly recommended for victims and their families to employ the services of an experienced sexual abuse attorney as they may be entitled to compensation for damages.”
