Woman And Child In Critical Condition After I-95 Crash Involving Semi-Truck

Emergency vehicles shut down the southbound lanes of I-95 at around 4:45 p.m. on Tuesday, September 25th, 2019 after a semi-truck slammed into several other vehicles and then overturned.

Police are still investigating the accident but say that traffic in the southbound lanes was slowing to a stop. A 39-year-old man driving a 2014 Kenworth tractor-trailer failed to stop for an unknown reason and collided with the Nissan in front of him. The collision absolutely destroyed the Nissan and sent it careening across all of the southbound lanes before it finally came to a stop.

The tractor-trailer then crashed into a Honda and Toyota that had been stopped in front of the Nissan, pushed them off of  the road. The semi-truck finally stopped after going through the guardrails and partially overturning in a northbound lane.

The crash claimed the life of the 61-year-old driver of the Nissan who was declared dead at the scene. Emergency responders pulled the 49-year-old driver of the Honda from her car and she was reported to have numerous serious injuries all over her body. Emergency responders also discovered that a child in the Honda was in cardiac arrest and had sustained other serious injuries. Both the woman and child were rushed to Christiana Hospital where they are listed as being in critical condition.

The 45-year-old driver of the Toyota and the driver of the semi-truck were also injured, although their injuries were not life-threatening.

An invesitgation is ongoing and the police are encouraging witnesses to call with any information.

When Can Legal Action Be Taken After A Fatal Accident?

Phil Edwards, an experienced truck accident lawyer, has provided his thoughts on the legal rights of truck accident victims and their loved ones.

"Truck accidents don't just impact those injured in the accident, often it's an entire family that suffers, especially when a victim succumbs to their injuries. Nothing can change the past, however, victims and their loved ones don't need to suffer without medical care because of financial stress caused by an accident.

A truck accident lawsuit can provide plaitniffs with the compensation that they both need and deserve. Compensation comes in two forms - a settlement or successful verdict. This compensation is intended to cover losses such as:

  • medical bills
  • wages that have been lost
  • physical agony
  • emotional truma
  • funeral and burial expenses

Taking legal action may seem like an overwhelming prospect immeditely after an accident which is why it's important to consut with an experienced attorney who can handle the paperwork, speak with insurance companies, collect evidence, and fight for the maximum amount possible."
