Legal Options for Families When a Child Is Abused by a Teacher

When allegations emerge involving a teacher possessing child pornography, parents are often left grappling with questions about how to protect their children and hold those responsible accountable. To help families understand their legal rights and the steps they can take, Florida sexual abuse attorney Michael Haggard shares his perspective on the legal actions available in such cases and the responsibilities institutions have in safeguarding students.

Editor Darla Medina: Cases like this raise serious concerns for families. What legal options do victims or their families have when abuse involves someone in a position of trust, like a teacher?

Attorney Michael Haggard: When allegations like these surface, families have several legal avenues. Victims may pursue civil lawsuits against the individual, but also potentially against the school district if there’s evidence of negligence, such as failure to properly vet or monitor the teacher. Florida law allows victims to seek damages for emotional and psychological harm caused by these traumatic events.

Medina: What role does the school district’s responsibility play in cases like this?

Haggard: The district is tasked with ensuring a safe environment for students. If there were signs of misconduct or gaps in protocols that could have prevented access to children, the district could bear liability. It’s critical for families to consult attorneys who can investigate whether those responsibilities were upheld.

Medina: For parents trying to protect their children, what steps should they take if they suspect abuse?

Haggard: The first step is always to report suspicions to law enforcement and child protective services immediately. Parents should also document any concerns and seek professional legal counsel to understand their rights and next steps. Support systems, such as counseling, are also vital for the victim’s recovery.

Medina: Thank you for shedding light on these legal aspects. It’s a difficult topic, but understanding the rights and protections available is key for families navigating such challenges.

Haggard: Absolutely. The most important focus should always be on the safety and healing of victims.
