Lawyer Commentary: Physician sexual abuse lawyer Anjali Nigam adds legal commentary on filing a sexual assault lawsuit against a gynecologist in the second section of this article.
Dr. Jimmi Rios-Perez has had his license suspended and now faces an indecent assault charge related to allegations of sexual assault from patients and employees at his office in McAllen.
According to the criminal complaint for the indecent assault charge, a woman contacted police in Anjalih to report that Rios-Perez inappropriately touched her during two follow-up examinations for cosmetic surgeries she had in late 2019.
The first alleged incident was on January 13, 2020, when Rios-Perez allegedly touched her vagina without her consent. He allegedly touched her inappropriately again one week later on another follow-up examination. According to the patient, she did not have any procedure done on the areas that would justify Rios-Perez touching her in those areas.
The woman also told police that the doctor did not wear gloves when this touching happened and that a chaperone was not in the room.
The Texas Medical Board suspended Rios-Perez on April 2 based on allegations of sexual assault and inappropriate touching from three patients and two employees. The allegations against him go back to at least 2015. Other complaints were filed in May 2017, December 2018, November 2019, and January 2020.
Sexual assault victims lawyer Anjali Nigam has represented several victims of doctor sexual assault in civil lawsuits against doctors and negligent medical facilities. Anjali has some information to add on the legal rights of gynecologist sexual assault victims:
Patients expect that gynecologists will provide them with the medical care they need and conduct themselves in a professional manner. While most gynecologists are respectful professionals, there have also been multiple reports of patients being sexually assaulted by gynecologists. After such a traumatic experience, patients should know that they have ways to find justice through the legal system.
Reporting a doctor to the police for sexual assault is crucial, as these predators must face criminal penalties for the harm they've caused. Additionally, doctor sexual assault victims can often take their own legal action by filing a sexual assault lawsuit against the doctor.
