Attorney contributor Guy D'Andrea, an experienced sexual abuse lawyer, represents victims who have been sexually abused by a teacher. In an interview, Brian shared his thoughts on the legal options of victims:
"Schools have a legal obligation to uphold the safety of children enrolled. When parents send their children to school, they trust they will be provided a safe learning environment. Sadly, across the United States, there have been various cases of teachers sexually abusing a student from their school. To ensure student's safety, schools must implement safety measures. For example, guards, cameras, and reporting systems."
"Victims sexually abused by a teacher should explore their legal options. First, they should secure an experienced sexual abuse lawyer's services. Sometimes when sexual abuse occurs, it is a result of negligence. An example of negligence is ignoring previous complaints of misconduct. If a school fails to implement proper security, it may be deemed negligent. In such cases, victims and their families should know they may have grounds for a civil lawsuit."
