In the aftermath of the arrest of a Fremont teaching assistant for multiple sexual assaults, CA child sexual abuse attorney Jason Amala shares valuable information regarding the rights of victims. In this conversation, Amala outlines the steps victims can take to report abuse and hold negligent schools accountable for their actions. His insights provide a roadmap for those sexually assaulted by a teacher assistant.
Editor Darla Medina: Thank you for joining us. What legal rights do victims of sexual assault by a teacher assistant have?
Attorney Jason Amala: Victims have several rights, including the right to report the abuse to law enforcement and seek protection. They can also file civil lawsuits against the perpetrator and the school for negligence.
Medina: How can victims hold schools accountable for failing to protect them?
Amala: Schools have a duty to provide a safe environment. If they ignore warning signs or fail to act on reports of inappropriate behavior, they can be held liable. Victims can pursue claims for damages, which can include emotional distress and other losses.
Medina: What steps should a victim take if they want to come forward?
Amala: It's important to document everything, including details of the abuse and any communications with the school. Victims should reach out to law enforcement and consult with a lawyer who specializes in these cases to understand their options.
Medina: Thank you for your insights, Jason. This is vital information for those affected.
