Authorities have arrested a 31-year-old math teacher on suspicion of having a sexually intimate relationship with a minor student at Escondido High School, located at 1535 N Broadway, Escondido, CA 92026. The Escondido Police Department (EPD) announced the arrest on Monday, August 12, 2024 according to NBC San Diego.
Last month, the EPD received a report of sexual misconduct and Ky Iri Tisdale of Escondido was taken into custody on Friday after detectives with the Escondido Police Family Protection Unit conducted an investigation. Tisdale was arrested while he and other teachers were setting up their classrooms at the school, according to Lt. Ryan Hicks with the EPD.
The department wanted to arrest Tisdale before Tuesday, which is the first day of classes in the Escondido Union High School District. Detectives also executed a search warrant at Tisdale's residence in Escondido to search for additional evidence, seizing his phone and computer.
Detectives believe there is at least one additional victim in this case, the EPD statement said. Both the alleged victims have graduated since the alleged incidents, the district confirmed.
Tisdale was booked at the San Diego County Sheriff's Department Vista Detention Facility for suspicion of oral copulation with a minor and unlawful sexual intercourse with a minor, both felony counts. He is currently being held on $250,000 bail and is due in court in North County on Aug. 13.
The Escondido Union High School District has placed Tisdale on administrative leave pending the outcome of the legal process. Superintendent Jon Peterson called the news "tremendously distressing" and said the district took immediate action to address the matter.
In the wake of the disturbing news that a teacher at Escondido High School has been arrested for alleged sexual misconduct with a minor student, we spoke with experienced California sexual abuse lawyer Jason Amala about the legal rights and remedies available to the victims. Amala provided valuable perspective on the steps the victims can take to hold not only the perpetrator accountable, but also the school district if negligence can be proven. Victims of such abuses often face a complex legal landscape, and Amala's experience helps guide them through the process of seeking justice and compensation for the harms they've suffered.
Editor Darla Medina: Thank you for joining us. As a lawyer who has handled cases of sexual abuse by teachers, what are the key legal rights and remedies available to the victims in cases of teacher sexual abuse?
Attorney Jason Amala: The victims in such cases have a few important legal avenues they can pursue. First and foremost, they can file civil lawsuits against the perpetrator for the sexual abuse they endured. These lawsuits can seek compensation for the trauma, emotional distress, and any other harms the victims suffered.
Additionally, the victims may have grounds to file civil claims against the school district. If it's found that the district was negligent in its duty to protect students from this kind of abuse, they could be held liable. This could involve allegations that the district failed to properly vet or monitor the accused teacher, or that it ignored warning signs.
Medina: That's really important for the public to understand. So beyond the individual perpetrator, schools and districts can be legally responsible in these types of cases?
Amala: Absolutely. School districts have a fundamental responsibility to keep students safe, and when they fail to do so, they can face significant legal consequences. In cases like this, we often find that the school district was aware of concerning behaviors by the teacher but did not take appropriate action. That kind of negligence is unacceptable and the victims deserve to be compensated.
Medina: And what advice would you give to victims as they consider their legal options?
Amala: My advice would be to act quickly in consulting with an experienced sexual abuse attorney. The timeline for filing civil claims can be limited, so it's important they get the process started as soon as possible. A good lawyer will also be able to guide them through the often-complex legal system and ensure their rights are fully protected. Most importantly, the victims should know that they are not alone, and that there are people and resources available to support them through this difficult time.
Medina: Thank you for providing that valuable perspective. I'm sure it will be helpful for the victims and the public to understand the legal recourse available in cases like this.
Amala: You're very welcome, Darla. My heart goes out to the victims, and I hope they are able to find justice and healing through the legal system. School should be a safe place for students, and when that trust is violated, the consequences must be severe.
