Understanding Your Rights to Justice After Child Sex Abuse

In the aftermath of serious allegations against a bowling coach in Indiana, many families may feel overwhelmed and uncertain about their legal options following such crimes. To provide clarity, we spoke with attorney Jeff Gibson, who specializes in cases of sexual abuse. He offers valuable information on the rights available to victims and their families, as well as the steps they can take to hold negligent parties accountable in civil lawsuits.

Editor Darla Medina: Given the serious nature of the allegations against a local bowling coach, what legal options are available for parents or victims of sexual abuse?

Attorney Jeff Gibson: Thank you for having me, Darla. Victims and their families have several avenues to explore. Firstly, they can pursue criminal charges, as we’re seeing in this case. However, they also have the option to file civil lawsuits against the abuser and any institutions that may have been negligent.

Medina: What does negligence look like in these situations?

Gibson: Negligence can manifest in various ways. For instance, if a school or organization failed to conduct proper background checks on staff or ignored warning signs of inappropriate behavior, they could be held liable. It’s about establishing that the institution had a duty to protect the child and failed in that responsibility.

Medina: What steps should a victim or their family take if they wish to pursue a civil lawsuit?

Gibson: The first step is to document everything related to the abuse. This includes keeping records of incidents, communications, and any witnesses. Consulting with a lawyer who specializes in these cases is vital, as they can guide families through the legal process and help assess the strength of their case.

Medina: Are there specific laws in Indiana that support victims of sexual abuse?

Gibson: Yes, Indiana has statutes that protect victims and offer them avenues for compensation. Victims can often file lawsuits even years after the abuse occurred, depending on the circumstances. There are also provisions for punitive damages in cases where gross negligence is proven.

Medina: What advice would you give to parents who suspect their child may be a victim of abuse?

Gibson: It’s crucial for parents to listen to their children and take their concerns seriously. Seeking professional help for the child is important, along with legal counsel to understand the options available. Reporting the abuse to authorities is also critical for the safety of the child and others.

Medina: Thank you for your valuable insights. This information is vital for families navigating these difficult situations.

Gibson: Thank you, Darla. It’s important that victims and their families know they are not alone and that there are resources available to help them seek justice.
