A Former High School Athlete Facing Multiple Charges of Sexual Assault

According to Canon City Daily Record, a former lacrosse player has been accused of sexual misconduct while attending Fairview High School located at 1515 Greenbriar Blvd, Boulder, CO 80305.

A federal lawsuit was filed on August 6, 2021, by two former female students that allege a former lacrosse player at the high school raped them during the 2016 - 2017 school year.

One victim alleged that the sexual assault took place during a 2016 Halloween party. The victim unwillingly entered a closet with the suspect, where he forcibly raped her. The victim reported the abuse to the school counselor and the Boulder Police school resource officer.

The second victim alleged that she was forced to perform oral sex on the suspect before he raped her during a school choir event in 2017. The crime took place in the baseball dugout on the school grounds. The victim did not report the event until 2019 but alleges that the high school's dean of students inquired about the event with one of her friends the day after the assault took place.

The suspect was allowed to transfer to a private school in Maine. The lawsuit reports that there was not any mention of his disciplinary actions on his record. He is now facing charges of sexual assault, kidnapping, and domestic violence.

Legal Rights of Victims of Sexual Assualt on a School Campus

Attorney contributor and sexual assault attorney Dan Lipman has represented school sex abuse victims and their families in civil lawsuits against negligent schools. Dan has provided some information regarding the legal rights of sexual assaults by students on campus below.

"The safety of all students should be the highest priority for all schools and school officials. These officials have a legal duty to do everything they can to protect their students from all forms of abuse, be it emotional, physical, or sexual. This includes abuse from school employees as well as other students. Schools should have certain security measures in place to prevent crimes from taking place. Examples of the ways schools can help to deter crimes could include security cameras and a sufficient reporting system. If a student falls victim to a sexual assault by a classmate on campus, it is important that an investigation takes place to document all of the circumstances surrounding the crime. The perpetrators should be identified and face the consequences. We should also ask how the school could have prevented the crime or sexual assault."

"In some cases, campus sexual assaults happen due to negligence by the school or school officials. An example would be officials knowing but ignoring a previous pattern of violence by a suspect. In instances of negligence, sexual assault victims and their parents may have a case for a lawsuit against the school district. If you have been a victim of a school campus sexual assault, you should seek advice from an experienced sexual assault attorney."
