In the aftermath of serious allegations involving a school employee, parents may feel overwhelmed and uncertain about their next steps. To help navigate this challenging situation, we spoke with experienced attorney Erv Nevitt, who specializes in cases of sexual abuse within educational settings. He offers valuable guidance on the legal rights available to victims and their families, as well as the necessary actions to hold negligent parties accountable.
Editor Darla Medina: Thank you for joining us, Erv. What rights do parents have if their child has been sexually abused by a school employee?
Attorney Erv Nevitt: Parents have several legal options. First, they can file a civil lawsuit against the individual who committed the abuse. Additionally, they may hold the school district accountable if they can demonstrate negligence, such as failing to provide a safe environment or not taking appropriate action when allegations arose.
Medina: What steps should parents take immediately after discovering abuse?
Nevitt: It’s vital for parents to document everything. They should report the abuse to law enforcement and ensure their child receives any necessary medical and psychological support. Consulting a qualified attorney early can also help guide them through the legal process.
Medina: How can parents prove negligence on the part of the school?
Nevitt: They must show that the school knew or should have known about the potential for abuse and failed to act. This can include evidence of prior complaints, inadequate training for staff, or a lack of proper supervision.
Medina: What can parents expect in terms of the legal process?
Nevitt: The legal process can be lengthy and emotionally taxing. It often involves investigations, depositions, and possibly a trial. However, it’s important for parents to understand that they are not alone. Many resources are available to support them.
