Fatal Crash on I-35 Leaves One Dead: Texas DPS Investigates

According to KWTX, the Texas Department of Public Safety (DPS) is conducting an investigation into a tragic crash that occurred in the early hours of Sunday morning, claiming the life of one individual. The incident took place on November 5, 2023, at approximately 12:00 a.m. on the northbound lanes of Interstate 35 near mile marker 345 in Waco, Texas.

According to the Texas DPS, the preliminary findings indicate that a semi-truck abruptly changed lanes, resulting in a collision with another vehicle. The impact caused the second vehicle to lose control and collide with another semi-truck in a devastating chain of events.

Tragically, the driver of the second vehicle, identified as a 46-year-old woman from Arlington, succumbed to her injuries. She was rushed to Baylor Scott and White in Waco, where medical personnel fought tirelessly to save her life. Regrettably, despite their efforts, she passed away due to the severity of her injuries. Texas DPS has confirmed that the next of kin of the deceased have been notified.

Wrongful Death Lawsuits After Fatal Semi Truck Accidents

In the aftermath of a tragic truck accident, the surviving family members often face immense grief and loss. However, they may also have legal avenues available to seek justice and compensation for their devastating circumstances. In this exclusive interview, we speak with renowned truck accident attorney Marc Lenahan, Esq., who provides valuable insights into civil cases and the rights of surviving family members. Discover the complexities involved in pursuing legal action and how experienced wrongful death attorneys can navigate the legal system to advocate for justice on behalf of their clients.

Editor Darla Medina (DM): Mr. Lenahan, thank you for joining us to shed light on what surviving family members of those killed in semi-truck accidents can do when seeking justice through civil cases.

Marc Lenahan, Esq. (ML): Thank you, Darla. It's my pleasure to be here and offer some insight on this important topic.

DM: What legal options might be available for surviving family members and others in similar situations after a fatal semi-truck accident?

ML: When a loved one is tragically lost in a semi-truck accident, surviving family members may have grounds to pursue a civil case against those responsible for the crash. In such cases, it is crucial to consult an experienced truck accident attorney who can guide them through the legal process.

DM:  Could you explain the basis for a civil case in these circumstances?

ML: Certainly. In a civil case, the goal is to hold accountable those who may be responsible for the accident and seek compensation for the damages suffered by the surviving family members. This can include economic damages, such as medical expenses and funeral costs, as well as non-economic damages, such as pain and suffering or loss of companionship.

DM:  What factors are typically considered when determining liability in a truck accident case?

ML: Establishing liability can be complex, but it often involves investigating several aspects of the accident. This can include examining the actions of the truck driver, such as whether they were driving recklessly, fatigued, or under the influence of drugs or alcohol. Additionally, the trucking company's role, including their hiring practices, vehicle maintenance, and adherence to safety regulations, may also be scrutinized.

DM:  Are there any specific challenges that families may face when pursuing a civil case against those accountable for a truck accident?

ML: Absolutely. Truck accident cases can be quite intricate due to the involvement of multiple parties, including the driver, trucking company, and potentially other entities responsible for the truck's maintenance or cargo. Additionally, navigating the legal system and dealing with insurance companies can be overwhelming for families already coping with the loss of a loved one. That's why it's crucial to have a knowledgeable attorney by their side to advocate for their rights and handle the legal complexities on their behalf.

DM: Thank you, Mr. Lenahan, for sharing your expertise on this matter. Is there anything else you would like to add?

ML: I would emphasize to anyone who has lost a loved one in a truck accident that they don't have to navigate this difficult journey alone. Seeking legal representation allows them to focus on healing and rebuilding their lives while their attorney fights for justice on their behalf. It's important to remember that they have rights and options, and by taking legal action, they can hold those responsible accountable for their actions.

DM: Thank you again, Mr. Lenahan, for providing valuable insights on civil cases following truck accidents. We appreciate your time and expertise.

ML: Thank you, Darla. It was my pleasure to be here today and help shed light on this important issue.
