Legal Guidance for Victims of Church Sexual Abuse

In the aftermath of alarming allegations against a church employee, many parents may feel uncertain about their options. To provide clarity, experienced Florida sexual abuse attorney Michael Haggard discusses the rights available to victims sexually abused by a church employee and their families. He explains how to navigate the legal system, the importance of reporting abuse, and ways to hold negligent parties accountable.

Editor Darla Medina: Thank you for joining us today, Michael. With the recent arrest of Hunter Eubanks, many parents may be wondering about their legal options if their child is abused by a church employee. What can you tell us about that?

Attorney Michael Haggard: Thank you for having me, Darla. When a child is sexually abused by a church employee, parents have several legal avenues to explore. First and foremost, it's crucial to report the abuse to law enforcement. This step ensures that the authorities can investigate and potentially bring criminal charges against the perpetrator.

DM: What about civil actions? Can parents file lawsuits against the church as well?

MH: Yes, they can. Civil lawsuits can be filed against the church or organization if there is evidence of negligence. This might include failure to properly screen employees, inadequate training, or not responding appropriately to previous allegations. Churches have a duty to protect their congregation, especially vulnerable members like children.

DM: What should parents keep in mind when considering legal action?

MH: Parents should gather as much evidence as possible, including any reports, witness statements, and medical records. Consulting with an attorney who specializes in sexual abuse cases is vital. They can help navigate the complexities of the law and ensure that the rights of the victim are protected.

DM: Are there specific statutes of limitations that parents need to be aware of in Florida?

MH: Yes, Florida has specific statutes of limitations for filing claims related to sexual abuse. In cases involving minors, the timeline can be extended, allowing victims to file lawsuits even years after the abuse occurred. It's important for parents to act promptly, as legal timelines can vary based on the circumstances.

DM: How can parents hold negligent parties accountable?

MH: Accountability often comes through civil litigation. By filing a lawsuit, victims and their families can seek damages for the harm caused. This not only serves justice for the individual but can also push institutions to improve their policies and practices to prevent future abuse.

DM: Thank you, Michael, for sharing this important information. This case highlights the need for vigilance and action when it comes to protecting our children.
