Can I File a Lawsuit For Being Shot Outside a Bar?

Attorney contributor Michael Haggard specializes in civil law in Florida. He often represents victims of violent crimes, such as bar shootings. During a recent discussion, Michael explained the legal rights of victims, including when they could file a lawsuit if shot outside a bar.

"Bar owners are required by law to offer protection for their patrons and employees. Criminal behavior, such as shooting or stabbings, is often preventable. The bar owner should provide enough security to protect them from these preventable threats. Basic security measures can include security cameras, trained security personnel, and sufficient parking lot lighting. If a bar owner fails to implement an adequate safety plan, they can be held liable in a civil lawsuit."

"In order to file a civil suit, the victim will need to show that the shooting was foreseeable. A bar shooting could be deemed foreseeable if acts of violence frequently occurred at the bar or in the vicinity. In such cases, the owner would be held responsible for the victims' damages if they failed to make sufficient increases to their security measures. To fully explore their legal options, victims of bar shootings should get legal advice from an experienced violent crimes attorney."
