Can I Sue For Sexual Assault in a Hotel?

Attorney contributor Brian Kent represents sexual assault victims in civil lawsuits in the state of New Jersey. For years, Brian has provided legal guidance from his law firm for sexual assault. During an interview, he shared his thoughts on filing a lawsuit for sexual assault in hotels.

"Hotels have a legal obligation to secure their property with preventative safety measures. These measures are to help minimize the chances of violent crimes occurring on the hotel property. These might include security cameras, well-lit common areas, and patrolling security guards. When someone is sexually assaulted in the hotel, the victim has legal rights to pursue both criminal and civil lawsuits to obtain justice."

"Reporting sexual assault to law enforcement will lead to a criminal investigation and possible criminal charges against the perpetrator. However, compensation may be available for the victim through a civil lawsuit. By exploring your legal options with an experienced sexual assault attorney, the victim can determine if filing a lawsuit is a viable option. Attorneys will need to prove that the hotel was negligent in providing a level of safety. If the hotel has a history of violent crimes but failed to add to its existing security, it may be deemed negligent."
