Former CA Church Choir Leader Pleads Guilty To Sexually Assaulting a Young Girl

According to the San Diego Union-Tribune, Rafael Magana, the former leader of a church choir, has pleaded guilty to one count of lewd acts on a child in San Diego Superior Court. The charges stem from his alleged involvement in a sexual assault against a 15-year-old girl who was a member of a local church's choir at Victory Outreach Church located at 2020 Sacramento St, Vallejo, CA 94590.

The incident, which took place in the Paradise Hills neighborhood, occurred on November 6, 2021. According to the San Diego Police Department, Magana, who was 25 years old at the time, drove the victim to and from a baby shower before proceeding to the secluded area. It was there that he is accused of sexually assaulting her before returning her home.

The victim, who was a member of the Victory Outreach Church in San Ysidro, had Magana as her church choir group leader. However, she did not report the assault to the authorities until March of the following year, citing a complex set of circumstances that contributed to the delay.

Following the victim's report, Magana was arrested last August and has remained in custody ever since. With his guilty plea, he faces a potential sentence of up to three years in state prison. Additionally, he will be required to register as a sex offender, further highlighting the gravity of his actions.

The community has been deeply disturbed by the revelations surrounding Magana's conduct, as it undermines the trust and safety that should be inherent within places of worship. Authorities commend the victim for her bravery in coming forward and urge anyone with additional information to come forward, as it may help shed further light on the case.

The sentencing hearing is scheduled for a later date, during which the court will consider the full extent of the harm caused and the appropriate consequences for Magana's reprehensible actions. This case serves as a reminder of the importance of vigilance and swift action in protecting the most vulnerable members of society.

Editor Darla Medina (DM): Bobby, thank you for joining us. In light of the recent case involving a church choir group leader's guilty plea to lewd acts on a minor, can you provide some insight into the legal rights available to victims of such abuse?

Bobby Thompson, Esq. (BT): Thank you for having me, Darla. It's crucial to understand that victims of sexual abuse, especially within a church setting, have legal avenues to seek justice and hold negligent parties accountable. It's essential for victims to know that they can pursue civil litigation against the responsible individuals, including the church itself, if it failed to provide adequate protection or ignored warning signs.

DM: That is indeed important information. Can you elaborate on the steps victims can take in holding negligent parties accountable?

BT: Certainly, Darla. Victims should reach out to an experienced attorney who specializes in sexual assault cases, particularly those involving clergy abuse. These attorneys have the expertise and experience necessary to navigate the complexities of these cases. They can guide victims through the legal process, helping them understand their rights and options, such as filing a civil lawsuit seeking compensation for the damages they have suffered.

DM: Thank you for highlighting the significance of legal representation in such cases. Are there any additional factors victims should consider when pursuing legal action?

BT: Absolutely. Victims must remember that they are not alone. There are support groups and organizations dedicated to assisting survivors of sexual abuse, providing them with resources and emotional support. It's also essential for victims to document any evidence they may have, such as medical records, therapy sessions, or any communication related to the abuse. This documentation can be instrumental in building a strong case.

DM: Thank you for shedding light on the legal rights available to victims of clergy abuse.

BT: Thank you once again for having me, Darla. Survivors of abuse need to know that they have rights, and there are legal professionals who are dedicated to fighting for those rights. By speaking out and seeking legal recourse, survivors empower themselves and contribute to the greater cause of preventing future abuse within religious institutions.
