Client Sexually Assaulted During Foot Massage

According to News4SA, a woman was allegedly sexually assaulted during a foot massage at Z W Foot Spa located at 9827 Potranco Rd #105, San Antonio, TX 78251. 

On Tuesday, January 18, 2022, 64-year-old En Li Sun was arrested after being accused of sexually assaulting a client during a massage. Sun allegedly touched and massaged the area near her genitals and anus, in addition to touching her breast. The victim filed a report on December 12, 2021. The massage therapist has been charged with indecent assault.

Can I Sue For Being Sexually Assaulted During a Massage?

"The massage therapy industry is founded on mutual trust between a massage therapist and a client. Clients are put in a vulnerable position that requires the massage therapist to act as a respectful professional. Touching of any kind outside the scope of practice during a massage is prohibited and a violation of this relationship. In many states, prior written consent is needed if the massage includes certain areas of the body. Sadly, many reports of massage therapists sexually abusing their clients have surfaced lately."

"Massage parlor owners are legally responsible for keeping their clients safe from preventable abuse. They should conduct background checks on all therapists and report any incident of misconduct. Failure to provide safety measures can cause the massage owners to be considered negligent."

"Victims may report the abuse to the facility in addition to law enforcement. A criminal investigation can help charge the perpetrator, but a civil lawsuit may help the victim get the compensation they deserve. If the victim's attorney can prove the facility was negligent, they could be held liable. A negligent owner might have ignored its commitment to provide necessary protection to its clients. By failing to report any misconduct by their massage therapists, the massage parlor owner can also be held accountable for the abuse. Victims should obtain legal guidance from an experienced sexual abuse victim attorney."
