CA Chaplain Accused of Sexually Assaulting Elderly Woman in Care Facility

A shocking incident has unfolded in California, where a hospice chaplain has been accused of sexually assaulting an elderly woman under his care, according to KCRA. The Sacramento County Sheriff's Office has arrested Arthur Apgar, a resident of Placer County, in connection with the investigation.

According to the authorities, Apgar, who worked as a chaplain at the care facility, was recently caught on camera sexually assaulting a 70-year-old non-verbal woman who was under his care. The family of the victim had installed a camera to monitor her well-being, and it was this footage that exposed the disturbing crime.

"To have something like this happen, I mean, it's just shocking to the conscience on so many levels," said Sheriff's Office spokesperson Gandhi. "We all have parents, we all have grandparents, we all have, you know, elderly family members that we care for dearly and this is something we couldn't imagine upon anybody."

Apgar has been booked into the county jail on four counts of sexual battery against a person who is seriously disabled or medically incapacitated. Shockingly, he was able to post bail and was released from custody shortly afterward, raising concerns about the safety of other potential victims. He has been a chaplain and pastor for over 40 years and worked within the hospice care center for eight.

The Sheriff's Office is urging anyone with information about the case or who may have had any contact with Apgar to come forward. They believe the chaplain has been in the industry for a long time and may have had access to several different facilities.

This case has sent shockwaves through the community, highlighting the need for greater scrutiny and oversight of those entrusted with the care of vulnerable individuals. As the investigation continues, the authorities are determined to ensure that justice is served and that any other potential victims are identified and supported.

Exposing Betrayal: Lawyer Outlines Legal Remedies for Sexually Abused Hospice Patients

In the wake of a shocking incident where a California hospice chaplain was accused of sexually assaulting an elderly woman under his care, the victim's family is grappling with a complex web of legal options. To navigate the possible legal avenues available for elder victims sexually abused in hospice care, experienced sexual abuse attorney Jason Amala sat down with us.

Editor Darla Medina: Thank you for speaking with us. In cases of ederly abuse, what legal rights do the families have?

Attorney Jason Amala: Thank you, Darla. This is a deeply troubling situation, and families of such have a number of legal avenues they can pursue to seek justice and accountability.

Medina: Can you explain what those options might be?

Amala: Absolutely. First and foremost, the victim or their family can pursue criminal charges against the abuser for the alleged sexual assault.

Additionally, the victim and her family may have grounds to file a civil lawsuit against the care facility for negligence. By allowing a chaplain or other accused abuser access to vulnerable patients without proper oversight or safeguards, the facility may have failed in its duty of care, which could make them liable for the harm caused.

Medina: That's a concerning possibility. What else can they do to hold the responsible parties accountable?

Amala: The care facility or any other entities aware of any concerns or complaints about the accuser's behavior that failed to take appropriate action could also be held liable for their negligence.

Medina: What advice would you give to victims or their families as they navigate this difficult situation?

Amala: My advice would be to act quickly in consulting with an experienced sexual abuse attorney who can help them understand their legal options and guide them through the process. Time is of the essence, as there may be important deadlines and procedures to follow.

Additionally, I would encourage the family to seek out resources and support services for the victim, as the emotional and psychological impact of this kind of betrayal can be profound. With the right legal representation and support, they can work to ensure justice is served and prevent similar tragedies from occurring in the future.

Medina: Thank you,  for your valuable insights on this disturbing case. We appreciate you taking the time to share your knowledge.
