Legal Recourse For Victims of Parking Lot Stabbings

Attorney contributor Guy D'Andrea is an experienced violent crime attorney who represents victims and their families in violent crime civil lawsuits. Brian has provided commentary on the legal rights of victims of parking lot stabbings.

All commercial property owners have a legal duty to maintain the safety of their patrons and employees. In order to ensure this safety, property owners must provide adequate security on the premises. This could include measures like hiring security guards or having well-lit parking lots. If an owner fails to provide adequate security and someone is injured, then the owner may be held liable for the crime.

In addition to inadequate security measures, in order for a victim to have grounds for a lawsuit against the owner, the crime must have been reasonably foreseeable. A reasonably foreseeable crime is one that occurs on a property with a prior history of violent crime and the owner did not improve security measures.
