Can I Sue If Sexually Assaulted By a Doctor?

Attorney Contributor Guy D'Andrea is a sex abuse attorney who helps victims of doctor sexual assault in New Jersey seek justice through civil lawsuits. He works to hold doctors, hospitals, and medical or addiction facilities accountable for their actions. Recently, Brian spoke about the legal options that are available to people who have been victims of sexual assault by an urgent care doctor.

"Patients often trust their doctors with their most personal medical issues, expecting to receive both compassionate care and professional skills. Unfortunately, some doctors take advantage of this trust, using it to satisfy their predatory desires. Unfortunately, medical professionals engaging in sexual misconduct and assault are an issue across the country. However, there are laws in place to protect patients from such behavior. Victims of sexual misconduct or assault can take legal action based on the medical professional's negligence."

"If a doctor commits a serious act of sexual misconduct, they could face penalties from their state's medical licensing board. These penalties may include losing their medical license and could also include time in jail or prison. The doctor and their medical facility could also be sued in civil court."

"Lawsuits can be filed for sexual assaults perpetrated by medical professionals. Such assaults can have serious and long-lasting consequences for victims and their families. It is important to understand your rights and the legal options available if you or someone you know has been a victim of this kind of crime. Victims of sexual assault by a medical professional or doctor may have the right to take legal action against both the doctor and the facility. It is strongly recommended that they speak with a lawyer specializing in doctor sex abuse cases to discuss their options. It is possible that they could be eligible for financial compensation."
