In the late afternoon of Saturday, September 28th, two construction workers present at an I-4 Ultimate site near the intersection of I-4 and SR 408 would become the latest victims of the ongoing $2 billion project.
Ulises Jesus Corrales Ibarra and David Trujillo, both workers employed by SGL Constructors, were struck by a concrete beam. Ibarra was pronounced dead at the scene, while Trujillo was translated to Orlando Regional Medical Center. Fortunately, the latter's injuries were non-life threatening and he has been released.
Details have yet to be released regarding the incident. All that is known is that a large concrete beam slipped off a piece of equipment and struck both construction worker.
This is not the first incident on an I-4 Ultimate construction site; Legal Herald previously reported another non-lethal worker injury earlier this month. Construction on all I-4 Ultimate site has been halted while this dreadful occurrence is investigated by officials as well as OSHA.
Michael Haggard, an experienced personal injury attorney and contributor to Legal Herald, offered the following legal insight for victims of construction accidents and their families:
"OSHA (Occupational Health & Safety Administration) currently indicates that the construction industry is one of the country's most dangerous professions. As a result, and through extensive research and analysis, they have been able to report on the most commons risks that endanger the health and security of workers on construction sites.
The third most common hazard that a construction worker is exposed to are falling objects. Just in 2014, almost 10% of construction accidents that required a medical intervention were categorized under OSHA's "struck-by" category.
While it is true that other types of accidents fall under the same category, such as being struck by a vehicle, the majority of "struck-by" accidents involve any type of debris or heavy object falling and injuring a worker.
Some of the injuries suffered due to falling objects in a work site include: traumatic brain injuries, spinal cord injuries; head injuries, piercing lesions, severe disfigurement, and partial or total blindness.
When workplace injuries occur, the victims have some legal options. While in most instances it is not possible to sue the employer after an injury, construction work opens the door for third parties to be liable for negligence after an accident.
If a lawsuit is not to be pursued, then a worker's compensation claim can also be considered. Both avenues to achieve compensation can be discussed with an experienced attorney who will be to help in navigating these involved legal options."
