OB/GYN Arrested For Taking Inappropriate Pictures of Patients

According to Fox 59, a woman accused a local doctor of sexually assaulting her and taking photographs of her private area without her consent during an exam at Women's HealthCare LLC located in Marion, IN.

On January 13, 2023, the Indiana Attorney General's Office filed a Petition for Summary Suspension to strip Grant County OB/GYN Dr. William David Moore of his medical license. The petition comes after a woman accused the doctor of sexually assaulting her during an examination and taking photographs of her without her consent. Since the accusation, the AG's investigation has revealed multiple other women who have come forward with similar accusations, and investigators have uncovered photographs of several patients' privates in medical files without their consent.

The AG's Office claims that Dr. Moore represents a "clear and immediate danger" and that more complaints continue to be submitted against him. Marion Health has stated that they will cooperate in the Attorney General's investigation. Dr. Moore has announced his retirement and is closing his office after 44 years of practice.

Can I Sue if Sexually Assaulted By an OB/GYN?

Attorney contributor Jeff Gibson is an experienced sexual abuse lawyer in the state of Indiana. He has represented numerous victims sexually abused by medical professionals. During a recent interview, Jeff shared his insight regarding when victims can sue if sexually assaulted by an OB/GYN.

"Medical professionals and medical centers are trusted to protect their clients from harm, including the risk of sexual assault. Medical offices have a legal and moral obligation to ensure that their clients are safe while they are under the care of a medical professional, especially when in a vulnerable examination. This includes providing a secure environment, adequate security personnel, and taking appropriate steps to screen individuals who may pose a danger to the clients through background checks. Furthermore, medical offices must provide appropriate policies for handling any reports of sexual assault, including reporting to the authorities and offering victims the necessary support services. Failure to do so could result in liability for the medical office, so it is essential that they take these precautions seriously."

"Victims who have been subjected to misconduct or assault at the hand of a medical professional have the right to seek justice through civil lawsuits against any negligent medical professionals and offices who failed to exercise reasonable care and put their clients at risk. It is crucial for medical offices to take all necessary steps to prevent such events from occurring and to take appropriate action if an incident does occur. Victims of sexual assault should be taken seriously and given the resources and legal remedies available to them to seek justice. They are encouraged to discuss their legal rights with a compassionate sexual abuse attorney."
