A 79-year-old physician from Irvine, Dr. John Carl Hoefs, has been sued by over a dozen women, including one identified as "Jane Doe 1," for allegations of sexual abuse. The lawsuit, filed Thursday, August 29, 2024, names Hoefs alongside Hoag Memorial Hospital Presbyterian, the UC Regents, and the Liver Specialty Center.
The lawsuit claims that Hoefs, a hepatologist, exploited his position of authority to sexually abuse, assault, and harass his patients. Jane Doe 1 described her experience, stating, "When that trust is broken, lives can be damaged and that's what happened to me." She reported Hoefs to the California Medical Board in October 2017 but claims no action was taken.
According to the suit, Hoefs manipulated his patients' lack of understanding regarding hepatology examinations to fulfill his own sexual interests. Attorney Morgan Stewart, representing the plaintiffs, asserted, "He was intentionally having patients disrobe... molesting them during the course of medical treatment with no medically probable reason." When asked about Hoefs' actions, Stewart affirmed, "Absolutely," labeling him as a predator.
Hoefs was arrested on May 3, 2024, and faces charges of sexual battery by fraud. After posting a $500,000 bond, he was released. If convicted, he could face over 20 years in prison. Attorney Raquel Cooper, representing the women, expressed that the plaintiffs feel "completely violated."
The lawsuit also points fingers at the medical facilities, alleging that staff failed to address or report Hoefs' behavior despite previous complaints. "We know of reports to the medical board, online postings referencing his behavior, and reports to other physicians," Stewart stated.
In response to the allegations, Hoag Memorial Hospital stated that Hoefs operated independently and is not employed by them. The hospital expressed dismay over the claims and condemned the alleged misconduct.
The Orange County District Attorney's Office is encouraging any additional victims to come forward as the investigation continues.
In the aftermath of allegations against Dr. John Carl Hoefs, a 79-year-old physician facing a lawsuit for sexual abuse, many victims may wonder about their legal options. To clarify these rights and the responsibilities of medical facilities, we spoke with Jason Amala, an experienced attorney specializing in sexual abuse cases. He shares valuable information on how victims can navigate the legal landscape and hold accountable those responsible for negligence.
Editor Darla Medina: Thank you for joining us. Many people may not know their rights after experiencing sexual abuse by a medical professional. What options do victims have?
Attorney Jason Amala: Victims have several legal avenues. They can file civil lawsuits against the perpetrator and any associated medical facilities. This includes seeking damages for emotional distress, medical expenses, and lost wages.
Medina: What about holding hospitals accountable? How can victims ensure that negligent practices are addressed?
Amala: Hospitals can be held liable if they failed to act on reports of abuse or if they allowed a known predator to continue practicing. Victims should document any complaints made to the hospital and gather evidence of negligence.
Medina: Are there specific steps victims should take immediately after an incident?
Amala: Absolutely. It's vital to report the abuse to the authorities and seek medical attention. Keeping detailed records of the incidents and any communications with the medical facility can strengthen their case significantly.
Medina: Thank you for your insights. It's important for victims to know they are not alone and that there are resources available to them.
