The intoxicated truck driver has been identified as Dataniel Shamaar Gilbert, a 26-year-old who is alleged to have fled the scene on foot after the crash. He was apprehended by police about a block away.

Gilbert, who has a long record of driving infractions, caused the tragic accident when he failed to stop at a red traffic light. Traveling in perpendicular direction were Nicolas Hatfield and Delaney Frye, the two 23-year-olds who lost their life after being struck violently by Gilbert’s truck.

Past infractions in Gilbert’s driving record include charges involving operating vehicles while intoxicated, as well as driving with a suspended license.

Two additional victims were identified in the accident, though their injuries were relatively minor, with only one requiring medical treatment at the local Eskenazi Hospital.

Contributor and attorney Jeff Gibson, who fights aggressively for the rights of victims of and their families, shared the following insight on the legal options for those who may have been gravely injured in a truck accident:

“Often times, truck accident victims and their families believe that insurance companies will offer a significant compensation that will cover all costs resulting from their accident. They also believe that the insurance policy will cover all medical treatment that may arise.

However, insurance companies and the adjusters who work for them generally have a single goal – to save their employer as much money as possible. These insurance representatives are trained to look for small details which will help diminish the amount that is paid out.

In other cases, even when the maximum amount is given out by an insurance policy, these will often not be enough to cover all of the medical expenses that are incurred in these grave accidents. This means that victims and their loved ones are to left to fend for themselves after all the trauma they have already experienced.

Fortunately, the law allows victims of truck accidents to pursue compensation through a truck accident lawsuit filed against negligent parties. More information regarding this legal avenue can be found by speaking with an experienced truck accident attorney.”
