Suspect in Custody After Shooting at Shopping Center Leaves 3 People Hospitalized

According to Fox 59, on Sunday morning around 2:30, police were dispatched to the 9500 block of Allisonville Road for reports of a shooting at the Castleton shopping center. When police arrived at the scene they found three people suffering from gunshot wounds in the parking lot.

All three victims were taken to the hospital and one of them was in critical condition. Indianapolis Metropolitan Police Department report that a suspect has been arrested for the shooting.

Can Parking Lot Owners Be Held Responsible For Violent Crime on Their Properties?

Attorney contributor Jeff Gibson works closely with victims and their families who have been injured or killed in parking lot shootings. Mr. Gibson has offered to share his knowledge on the legal options available to these victims.

“There are certain circumstances when victims injured or killed in shootings on commercial properties may have the option to file a lawsuit against the property owner. First, the shooting must have only occurred due to inadequate security. Every commercial property owner has a legal duty to provide adequate security on their premises so that their patrons and employees are protected from preventable crime. If a property owner fails to provide adequate security and a shooting injures someone due to their negligence, then the victim may have grounds for a lawsuit against that property owner”, explains Mr. Gibson.

“The second component to be met in order for a violent crime victim to have grounds for a lawsuit against a property owner is that the crime must be considered reasonably foreseeable. A reasonably foreseeable crime is when a shooting or stabbing occurs at a place with a prior history of violent crime, but no security upgrades were made. Essentially, if a reasonably foreseeable shooting occurs in a parking lot due to inadequate security, then the property owner may be considered responsible for the crime”, concludes Mr. Gibson.
