Can I Sue For a Deadly Tow Truck Accident?

Attorney contributor Anjali Nigam is an experienced tow truck accident attorney in Texas. Anjali represents victims injured in commercial truck accidents. Below, Anjali shared insight into the legal rights of victims involved in deadly accidents involving tow truck drivers.

"Victims injured or the surviving family members of those killed in tragic auto accidents nearly always experience emotional and financial difficulties following the accident. This can include medical expenses and a loss of income. It is critical that victims understand their legal options to seek financial compensation. In addition to financial benefits provided by insurance, victims may have grounds to file a civil lawsuit."

"Many different things can cause auto accidents, but too often it is the negligence of one of the drivers. When that negligent driver is driving a commercial truck or tow truck, the damages can be greater due to the size and weight of the vehicle. Commercial truck drivers often are required to carry a special license. To get this license, they learn how to avoid hazards that may cause dangers on the road. The towing company must ensure each driver is licensed and trained to drive the tow truck. If a company fails to maintain its driver's licensing status, it can be deemed negligent. Furthermore, if the company is aware that a driver has a history of reckless driving but allows them to continue driving, they could be held liable for any accidents caused by the driver."

"In such cases of negligence, if there are injuries or deaths, victims could also file a wrongful death lawsuit against the driver or the tow truck company. Those injured in tow truck accidents should acquire the services of an experienced truck accident attorney to learn more about their legal options."
