One Injured When Tractor Trailer Fails to Yield

According to ValleyCentral, on Monday morning, a tractor-trailer crash near Elsa resulted in the driver of a 2014 Chevrolet Silverado being airlifted to a local hospital.

According to the Texas Department of Safety, the accident occurred at 11:45 a.m. on February 20, 2023. The truck tractor towing a caliche trailer was stopped at the intersection of SH 88 and FM 490, facing west. The Chevrolet was traveling north on SH 88 when the truck tractor failed to yield the right of way at a stop sign. The two vehicles collided, and the driver of the Chevrolet was airlifted to Valley Baptist Medical Center.

Fortunately, the truck tractor driver was not injured in the crash. DPS is still investigating the cause of the accident and the extent of the injuries of the Chevrolet driver.

Justice For Truck Accident Victims

Attorney contributor Marc Lenahan helps victims file truck accident lawsuits across the state of Texas. As an experienced tractor-trailer accident attorney, Marc recently shared some information regarding the legal options available for accident victims.

"The duty of care for trucking companies is clear and well established in the law. Trucking companies must ensure the safety of the public by ensuring that their drivers, vehicles, and cargo are properly maintained and operated in a safe manner. When a trucking company fails to fulfill its duty of care, it can be held liable for any injuries caused by its negligence."

"Truck accidents can involve a wide range of issues, from driver fatigue to mechanical failure. Negligence can involve failing to properly maintain the truck, failing to properly train the driver, or failing to inspect the cargo."

"Those injured in truck accidents have the right to seek compensation for their injuries. This includes both economic and non-economic damages. Economic damages are those that can be quantified, such as lost wages and medical expenses. Non-economic damages are those that cannot be quantified, such as pain and suffering. The amount of damages that may be recovered depends on the specific facts of the case. It is important for those injured in truck accidents to consult with an experienced tractor-trailer attorney. An attorney can help assess the case and determine the best course of action to pursue. An attorney can also ensure that the victim’s legal rights are protected and that they receive the maximum compensation available."
