Man Arrested After Deadly Suspected DUI Crash

According to WTHR.com, on October 17th around 1:30 a.m., Dario Chagollan was driving along 116th Street west of Hoosier Road.

Police reported that Chagollan struck a Toyota from behind. When authorities arrived the Toyota was completely ablaze. The woman driving the Toyota died at the scene.

Chagollan was treated at the hospital for non-life-threatening injuries. Later he was arrested for operating a motor vehicle while intoxicated causing death.

Every state allows victims injured or family members of victims killed by drunk drivers to file a personal injury lawsuit against the driver. In addition to this, many states have dram shop laws that may allow these victims to sue the alcohol vendor who sold the driver alcohol before the crash.

In Indiana, the dram shop law states that alcohol vendors and social hosts can be held liable for injuries suffered in an alcohol-related accident if:

  • they provided alcohol to someone who was obviously intoxicated at the time, or
  • the intoxication was a foreseeable cause of the crash and of the subsequent injuries.
