Legal Recourse For Victims Injured in Drunk Driving Accidents

Attorney Jeff Gibson helps victims of drunk driving accidents and their families secure the financial compensation they deserve. Here is some insight from Jeff on the legal options available to these victims in Indiana:

Every state allows victims injured or family members of victims killed by drunk drivers to file a personal injury lawsuit against the driver. In addition to this, many states have dram shop laws that may allow these victims to sue the alcohol vendor who sold the driver alcohol before the crash.

In Indiana, the dram shop law states that alcohol vendors and social hosts can be held liable for injuries suffered in an alcohol-related accident if:

  • they provided alcohol to someone who was obviously intoxicated at the time, or
  • the intoxication was a foreseeable cause of the crash and of the subsequent injuries.
