Denver-area doctor Justin Neisler was indicted last week on eight counts of child pornography-related offenses. Neisler is accused of secretly filming young male patients and posting child pornography on the internet.
The 31-year-old doctor has been indicted for three counts of production of child pornography, four counts of transportation of child pornography, and one count of possession of child pornography.
Federal authorities arrested Neisler on Anjalih 13 and originally charged him with one count of posting child pornography online. According to court documents, Neisler admitted to filming young male patients. The most recent court documents list three alleged victims, referred to as Minor #1, Minor #2, and Minor #3.
These alleged crimes occurred in Adams, Denver, Jefferson, and Arapahoe counties, according to court documents. Neisler's former place of practice was at St. Anthony Family Medicine on the North Health Campus in Westminster. He was fired from that facility following his arrest.
The court records go on to state that "The defendant, a doctor, admitted to surreptitiously videotaping naked males as young as eleven years old during physical examinations. According to the agent, a review of these videos reflected that the defendant appeared to gain sexual gratification from the examinations."
Court documents say that investigators found a "spy pen camera instruction manual", a "Fab Quality HD Spy Pen Camera" with a 16 GB memory card, and a laptop, cell phone, external hard drive, and Apple Airport Time Capsule.
The investigation into Neisler began after the FBI received a tip from the National Center for Missing and Exploited Children that a person with an internet address matching Neisler's home address had uploading child pornography to the social media website Tumblr in October of 2018.
Neisler has pleaded not guilty to all eight counts. Prosecutors have filed a protection order to protect the identities of the victims and the trial date has been pushed back so that lawyers have more time for evidence and discovery procedures.
Attorney contributor Dan Lipman has experience helping victims of doctor sex abuse find justice through civil lawsuits. Here are a few of Dan's thoughts on the legal rights of doctor sex abuse victims:
Sexual abuse is a horrific crime regardless of the perpetrator. But when the abuser is a doctor, this heinous crime is an even more egregious violation of trust. We all trust doctors to care for not just us, but for our children as well. Hearing that a doctor has violated this trust by traumatizing a child with sexual abuse is one of the most difficult ordeals a parent can bear.
When a child is sexually abused by a doctor, the victim and their family must be aware of their legal rights. The criminal justice system handles the prosecution of these predators, but the legal options for these families do not always end here. In many cases, doctor sex abuse victims and their families may have grounds for a lawsuit against the doctor and the facility where the abuse happened.
