According to USA Today, a JTR Transportation tour bus heading for Niagara Falls rolled over near Exit 40 on I-90 West Bound in Brutus, New York.
At approximately 12:40 p.m. on August 14, 2021, a tour bus veered off of I-90, heading west near exit 40 to Weedsport before rolling over. The tour bus, driven by a JTR Transportation operator, was heading from Poughkeepsie to Niagara Falls and had left at 6 a.m. that morning.
All 57 passengers, ranging in age, were sent to the hospital for treatment of their injuries. Injuries are reported to vary from minor to critical, police have reported. A relative of one of the passengers told USA Today that his mother is being treated for glass in her eye and will have to undergo back surgery due to the crash.
The crash victims were sent to several different hospitals including Auburn Community Hospital, Upstate University Hospital in Syracuse, and Crouse Hospital in Syracuse.
Police had the area closed off until that evening and are still investigating what caused the driver to veer off the road. JTR had yet to comment on the situation, just stating that the matter remained fluid.
Attorney contributor Laurence Banville is an experienced personal injury lawyer who has represented numerous injured victims of bus and other auto accidents. Laurence shared some of his knowledge on the legal rights of injured victims of auto accidents and the financial compensation they might be entitled to:
"In the aftermath of a serious accident with injuries or even deaths, the victims involved and the families of those killed struggle with several serious emotional and financial difficulties. If you have been involved in a serious bus accident, you may be wondering about your family's options for financial compensation."
"Often insurance will cover part of the damages. However, many victims and families need additional financial compensation, which might be obtainable through lawsuits."
"In personal injury lawsuits or wrongful death claims, the victim can sue the negligent driver. Additionally, for crashes involving commercial vehicles, like buses, the lawsuit can hold the driver's employer accountable if the crash was the driver's fault and the employer is also found negligent. One example where a company could be considered negligent can include if the driver had a history of a DUI or reckless driving yet the company failed to run a background check that would have shown such history."
"In the event that you or a loved one has been involved in an auto accident, it may be necessary to seek the aid of an experienced personal injury lawyer to understand your legal rights better."
