Attorney contributor Jason Amala is an experienced violent crimes lawyer licensed in the state of California. He has represented victims of sexual abuse for years and has provided commentary on the legal rights of victims sexually assaulted by a plastic surgeon.
“As patients, we put our trust in our doctors and expect the medical professionals to behave professionally. Sadly, some doctors abuse their positions of power and trust with their patients and commit crimes against them, such as sexual assault. These doctors exploit their patients’ vulnerability in order to abuse and assault them. These medical professionals are held accountable for their heinous acts thanks to the justice system. Victims should be aware of their legal options to receive such justice.”
“Medical facilities and doctors are legally obligated to uphold the safety of their patients. Sexual misconduct by doctors, including plastic surgeons, is often the result of negligence. In some cases, the professional’s employer may be considered negligent if it has failed to prevent sexual abuse. An example could include previous misconduct complaints filed against the doctor, but they were permitted to continue seeing patients. In these negligence cases, victims and their families may have grounds to file a civil lawsuit and could even receive compensation for their abuse.”
