Attorney contributor, Anjali Nigam represents victims of violent crimes in private, civil lawsuits. He has generously offered his own advice to help these victims and their families with important steps of filing a case, should they choose to.
"There are two things to understand before deciding to file a civil case. First, the criminal justice courts were not developed to properly compensate a victim of a violent crime. The system was designed to provide a punishment of the crime against the offender. Second, a civil litigation court generally has a better likelihood of awarding monetary damages. Providing proof that an offender, or third-party, acted negligently may be at the hands of a civil attorney.
Negligence is an appropriate term for someone or something that ended in a failure. For instance, property owners are often referred to as the third-party and have some legal obligation to provide safety for their customers, visitors, and residents. If a property owner fails to provide a well-lit parking lot, then it may be proved that an act of negligence occurred and are responsible for a portion of the crime committed on their property.
When something as tragic as a shooting occurs, especially when a loved one is involved, lives can be turned upside-down. When people are victimized by violent crimes, many routes of change can happen whether that be medical expenses, long-term care and in the worst cases, funeral expenses. Knowing where to begin and who to trust can play a vital role in how these expenses may be covered. To better understand your compensation factors for suits that involve shooting incidents, speaking with a civil attorney can prove to be a helpful tool," describes Nigam.
