Firefighter Faces Felony Assault Charges After Stabbing at All Stars Bar and Grill

WPRI Eyewitness News claims that on early Wednesday morning a stabbing occurred in the parking lot of All Stars Bar and Grill located on 685 Airport Rd, Warwick, RI 02886. 

John Decarlo, a New York City firefighter, stabbed two men in the parking lot of All Stars Bar and Grill. The victims were taken to Rhode Island Hospital with severe injuries after being stabbed in the neck and torso. According to police, both victims are currently in stable condition.

Decarlo was arraigned on Wednesday and released on $50,000 surety bail. He was charged with two counts of assault with intent to commit a specified felony, weapons other than firearms prohibited, and disorderly conduct.

Can Bar Owners Be Liable For Violent Crime on Their Properties?

“Commercial property owners are legally required to protect their employees and customers from preventable dangers on or around the premises. Property owners must offer adequate security to all patrons. Adequate security includes video surveillance or a reasonable amount of security guards on site. When adequate security is not offered there may be grounds for a lawsuit. For instance, if someone gets stabbed at a bar because the owner acted negligently by not providing proper security measures, then he or she could be liable for the victim’s injuries”, states Mr. Kent.

However, in addition to proving inadequate security a violent crime victim’s attorney must also be able to show that the crime committed was reasonably foreseeable. A reasonably foreseeable crime is one that occurs on a property with a history of criminal violence. Overall, inadequate security followed by a reasonably foreseeable crime may allow the violent crime victim to bring forward a lawsuit against the property owner.
