Legal Options Available to Victims of Bar Shootings

Attorney contributor Brian Kent of www.crimevictim.Attorney represents victims and their families injured or killed in bar shootings. Below Mr. Kent has generously shared his insight on the legal options available to these victims.

It is the legal duty of all commercial property owners to keep their patrons and employees safe from the threat of preventable dangers. In order to successfully fulfill this duty, property owners must provide adequate security on their premises. This may include hiring security personnel, installing video surveillance, and establishing well-lit parking lots. If a bar owner does not provide adequate security and a crime such as a shooting occurs due to their negligence, then the victims may have grounds for a lawsuit against the owner.

However, there are more requirements necessary to have a valid security negligence lawsuit. In order to file a lawsuit against the property owner, a victim’s lawyer must also prove that the crime was reasonably foreseeable. An example of a reasonably foreseeable crime would be if a shooting occurred at a bar with a prior history of criminal violence, yet no security improvements were made. Each case is unique, but in general if a reasonably foreseeable shooting occurs at a bar due to negligent security, then the owner may be held liable for that crime.

If you or someone you love has been a victim to a restaurant shooting, you can learn more about your legal options by reviewing your case with an experienced crime victim attorney.
