RegalCare at Southport Resident Arrested on Sexual Assault Charges
A resident of RegalCare at Southport has been arrested for allegedly sexually assaulting a 9-year-old girl while she was visiting a relative at the nursing home. 77-year-old Dino Carlo Gioia has been charged with third-degree sexual assault, risk of injury to a child, second-degree unlawful restraint, and breach of peace.
According to the police, the girl was visiting a relative at the facility on Christmas Eve when Gioia pulled her towards him by the waist, grabbed her private parts, and told her she was beautiful.
The girl’s mother stopped the assault and reported Gioia to the police.
The police say that they had responded to several previous reports of sexual misconduct involving Gioia. There had been complaints of him exposing himself, inappropriately touching dementia patients, and threatening to rape a female patient. He was not arrested for any of these allegations.
Gioia has been a resident at RegalCare for about one month. He appeared in court on January 9 and was held on a $100,000 bond. His next court date is scheduled for February 27.

Legal Options For Nursing Home Sexual Assault Victims and Their Families
Attorney contributor Brian Kent of AbuseGuardian.com is a former sex crimes prosecutor who has transitioned to represented sexual assault victims and their families in civil lawsuits. Brian has some thoughts to add on the legal rights of those who have been sexually assaulted in nursing homes.
Nursing homes should be safe environments for residents, staff members, and visitors. But sadly, there have been several reports of people being sexually assaulted by nursing home staff members, residents, visitors, and intruders. When a sexual assault happens at a nursing home, it’s important to investigate the perpetrator and also the facility for possible negligence.
Some nursing home sexual assaults happen at least partly due to negligence. For example, a nursing home could be considered negligent if one of their residents had shown a pattern of sexual misconduct or abuse but was permitted to continue living at the facility, allowing them to abuse more victims. In cases involving negligence, victims and their families may have the right to file a lawsuit against the facility.
