Sitka Community Hospital Doctor Accused of Sexual Assault
A Sitka doctor has been charged with sexually assaulting one of his patients multiple times in 2018.
75-year-old Richard W. McGrath is a family doctor who worked in the emergency room at Sitka Community Hospital for four years. He also worked for one year at the hospital’s clinic. A patient reported him for sexual assault in December 2018 and he was placed on administrative leave shortly after.
Last week, McGrath was indicted after an investigation and collection of additional evidence. He is currently outside of the country, so a $25,000 extraditable warrant has been issued. If he is found abroad, he could be arrested and brought back to Alaska to be arraigned.
A spokesperson for the Sitka Police Department said that there are not thought to be any other victims at this time.
Legal Recourse for Victims of Sexual Assault by Doctors
Attorney contributor Brian Kent of AbuseGuardian.com is a former sex crimes prosecutor who now represents survivors of sexual assault in civil lawsuits. Here are some of his thoughts on how those who have been assaulted by doctors and other medical professionals can find justice:
We all trust doctors and other medical professionals to provide us with the quality of care we deserve when we need it and to treat us with respect. This trust is usually deserved, but there have also been reports of doctors sexually assaulting their patients in all 50 states. Survivors of sexual assault by doctors deserve justice for the trauma they’ve suffered. And the perpetrators of these crimes deserve to be held accountable, along with those who have enabled them through negligence.
Reporting a doctor sexual assault to law enforcement is important, but the legal options for survivors don’t end here. In many cases, survivors may also have options for justice through civil lawsuits. Doctors who sexually assault their patients can be held liable for damages in many cases. Additionally, hospitals and other facilities can also be held liable if their negligence contributed to the abuse, such as failing to respond to previous reports of sexual misconduct by the perpetrator.
