Attorney contributor Laurence Banville of Banville Law has offered his thoughts on the legal rights of truck accident victims.

"When someone is killed in an accident involving a tractor-trailer their loved ones typically have the right to seek justice on their behalf through a wrongful death lawsuit. This lawsuit is filed against the party whose actions contributed to the cause of the accident.

The purpose of a wrongful death lawsuits is to provide a grieving family with financial compensation that will help them to pay for:

  • funeral and burial expenses
  • lost income
  • lost inheritence
  • physical pain
  • emotional pain

Taking legal action may seem like an overwhleming prospect while grieving, however, strict time limits known as the statute of limitations are in place. These time limits allow those who are eligble only a short period of time during which they can take legal action. Once this time limit has passed, there will be no way to recover compensation.

If you have lost a loved one in an accident involving a tractor-trailer it's wise to contact an experienced attorney as quickly as possible so that they can begin the process to taking legal action on your behalf."
