Truck Driver Arrested Fatal Collision With 2 on Motorcycle

In Salem, Oregon, police arrested 39-year-old Eduardo de Lima Vargas following a suspected drunk driving accident that left two dead at around 12:30 a.m. on August 19. Officers said that Vargas ran a red light while driving drunk and struck a motorcycle, killing both riders.

Vargas was driving a pickup truck with an occupied horse trailer attached, going westbound on Highway 22 when he struck the motorcycle, which was attempting to turn eastbound onto Highway 22 from the I-5 southbound ramp. Both riders were thrown from the motorcycle on impact. Emergency responders rushed them to a local hospital, but they were pronounced dead not long after arrival.

The motorcycle was lodged underneath the truck, which caused both vehicles to catch fire. Officials extinguished the fire and saved the horse from the trailer.

Vargas has been charged with two counts of manslaughter, reckless endangering, reckless driving, and one count of DUI.

Lawsuits For Drunk Driving Victims In Oregon

Attorney contributor Brian Kent of CrimeVictim.Attorney has experience defending the victims of drunk drivers. Here are some of his thoughts on the legal options for these victims:

When a negligent driver causes a car accident, the victim often has grounds for a personal injury lawsuit against that driver. In Oregon and in many other states, the victims of drunk drivers also sometimes have grounds for a lawsuit against an alcohol vendor who served the driver that night. According to state dram shop laws, alcohol vendors can be held liable for drunk driving injuries if they served alcohol to the drunk driver after that person had become “visibly intoxicated.”

Dram shop laws help demand accountability from third parties whose negligence contributed to the drunk driving accident. The victims of drunk drivers can recover financial compensation for various damages related to their injuries, including:

  • Medical expenses
  • Past and future lost wages
  • Pain and suffering
  • Loss of financial support for families of fatal DUI accident victims

Determining your best course of legal action will require assistance from an experienced DUI accident victims lawyer. Your lawyer can help you determine if you qualify for a personal injury lawsuit, a dram shop lawsuit, or both – along with making sure you get the full financial compensation you deserve.
