Legal Options Open to Victims of Apartment Stabbings
Have you been injured in an apartment stabbing recently? Or has someone close to you been affected by a similar situation? Below, we have included expert legal advice from attorney contributor Brian Kent of crimevictim.Attorney so that you can properly discuss your legal options with friends and family:
“Essentially, what apartment stabbing victims and their families should know is that property owners need to ensure the safety of all customers and employees on site. To protect their patrons from preventable dangers, then, property owners must provide adequate security on or near the premises. This can include things like video surveillance and security personnel, but of course the options vary. Thus, when adequate security is not offered and someone falls victim to say a stabbing or shooting, the property owner may be held liable for the crime inflicted on the victim. And then a victim may be able to bring forward a lawsuit against the owner.”
“Nonetheless, a violent crime victim’s attorney must also prove that the crime that was committed was reasonably foreseeable in addition to a showing of inadequate security. What this means is that if an apartment owner knew that crime was rising in the area, did not decide to enhance security measures, and then someone got stabbed, he or she may be held liable for the crime. It is important to remember, though, that a crime victim attorney must prove that the security was inadequate and that the crime was reasonably foreseeable for there to be a valid lawsuit.”
