Legal Options for Families and Victims of Stabbings

Attorney contributor Brian Kent works with victims of violent crime in civil lawsuits. Below he has generously shared his expertise on the legal options available to victims and their families in crimes like these.

“Whether a victim of a stabbing survived or not, years of therapy, bills and other care can be accrued. Usually, these bills are the burden of the victim or families of the victim. To ensure monetary damages are awarded when a violent crime like this has been committed, a civil attorney can help.

There are two steps to obtain compensation for a victim or their family. The first step to receive compensation is through the criminal justice system if a perpetrator was arrested and charged. Upon conviction and sentencing of the crime committed, restitution can be awarded through a Court Order. Second, the victim or the family of the victim will need to begin a civil suit against the perpetrator.

Property owners may also be held liable for their part in negligent security. Each owner has a duty to provide a safe environment like well-lit parking lots, cameras, and/or bodyguards to their guests and employees. It will be in the hands of the attorney to prove that the property owner failed to provide adequate security.” described Kent.
