An employee has been accused of sexually assaulting a patient at Thomas Jefferson University Hospital.

Former Jefferson Hospital Employee Rafael Alicea Charged with Institutional Sex Assault

A former employee of Jefferson University Hospital in Philadelphia has been arrested after a patient accused him of sexually assaulting her after surgery in January 2019. 41-year-old Rafael Alicea is charged with institutional sexual assault and indecent assault.

The patient, 28-year-old Rose Tummarello, spoke with 6 ABC regarding the alleged assault. She said that Alicea sexually assaulted her in two different rooms at Jefferson on January 29 while her parents waited outside of the door. These assaults allegedly happened shortly after she had undergone a nine-hour surgery.

Alicea had been tasked with transporting Tummarello between rooms. He is accused of sexually assaulting her in the surgery room and again in the recovery room. Tummarello says that he groped her and kissed her neck following the surgery. He then brought her to the recovery room, where he allegedly sexually assaulted her in the same way.

Legal Options For Victims of Sexual Assault in Hospitals

Attorney contributor Brian Kent of AbuseGuardian.com represents sexual assault victims in civil lawsuits against predators and negligent third parties, such as hospitals that have failed to protect their patients. Here is Brian with some thoughts on the legal rights of those who have been sexually assaulted by hospital staff members:

Hospitals should be safe places and no patient should ever have to worry about becoming a crime victim while undergoing medical care. Hospital officials have a legal duty to ensure the safety of their patients. When a patient is sexually assaulted at a hospital, it’s important to ask if this legal duty was met.

Some hospital sexual assault cases only happen due to negligence. For example, a hospital could be deemed negligent for failing to investigate previous allegations of sexual misconduct against an employee who was later arrested on sexual assault charges. In these cases of negligence, the victim may have grounds for a lawsuit against the hospital.
