Legal Recourse For Restaurant Shooting Victims And Their Families
Attorney contributor Brian Kent of CrimeVictim.Attorney represents restaurant shooting victims and their families in civil lawsuits. Mr. Kent has offered to share his insight on the legal options available to these victims.
“All commercial property owners must fulfill an important legal duty of keeping their patrons and employees safe from preventable dangers. Property owners of places such as restaurants and bars must provide adequate security measures to anyone that visits their premises in order to prevent any reasonably foreseeable criminal violence. A crime may be deemed reasonably foreseeable if a restaurant had a prior history of criminal violence, but no security improvements were made”, explained Mr. Kent.
He continued by stating, “If a restaurant owner fails to provide adequate security and a violent crime like a shooting does occur due to their negligence, then the owner may be held partially liable. However, the victim’s lawyer must prove that the crime was also reasonably foreseeable. If the incident is proven to be caused by negligent security and deemed reasonably foreseeable, then victims may have grounds for a lawsuit.”
If you or a loved one has experienced something similar to this, you can learn more about your legal options by reviewing your case with a crime victim lawyer.
