Are Bar Owners Liable for Shootings on Their Properties?
Attorney contributor Brian Kent of CrimeVictim.Attorney is a former prosecutor who now represents crime victims in civil lawsuits. Here is some info from Brian on bar owner liability for shootings on their premises and the legal options available to bar shooting victims and their families:
Being a property owner comes with many responsibilities, but maintaining the safety of that property is the most important. For the owners of bars and nightclubs, this obligation to safety also includes providing reasonable security measures which can reduce the risk of violent crime at the establishment. In some bar shooting cases, the shooting may have been prevented if there had been better security standards at the property. In these types of cases, bar shooting victims and their families could have a case for a lawsuit.
Establishing bar owner negligence after a shooting can be complicated. The victims’ legal counsel must prove that the shooting was reasonably foreseeable and only occurred due to inadequate security or another form of negligence. An experienced crime victim attorney can analyze the case and determine if negligence played a role in enabling the shooting to occur.
