Legal Options Available to Victims Injured in Restaurant Stabbings

Attorney contributor Brian Kent of CrimeVictim.Attorney represents victims of violent crime in civil lawsuits. Mr. Kent has generously shared his knowledge on the legal options available to these victims and their families.

“Essentially, what restaurant stabbing victims and their families should know is that property owners are legally obligated to ensure the safety of all customers and employees on site. In order to successfully protect their patrons from preventable crime, property owners must provide adequate security on their premises. This may include, but is not limited to things like well-lit parking lots and security guards. Thus, when adequate security is not provided and someone is injured in a violent crime, such as a stabbing, the property owner may be held liable”, explained Mr. Kent.

He continued: “However, a violent crime victim’s attorney must also be able to prove that the crime committed was reasonably foreseeable in addition to a being caused by inadequate security. Therefore, if a restaurant owner is aware of prior crime in the area, does not improve security measures, and then someone is injured in a stabbing, he or she may be held liable for the crime. Essentially, if a reasonably foreseeable crime injures or kills someone due to inadequate security, then the victim may have grounds for a lawsuit against the property owner.”
