Legal Rights of Nursing Home Sexual Abuse Victims & Their Families

Former sex crimes prosecutor Brian Kent is a founding partner of AbuseGuardian.com – a team of former prosecutors who now represent victims of sexual abuse in civil cases. Brian has offered to share some general information on the legal rights of nursing home abuse victims and their families:

It’s never easy to place a loved one in a nursing home. But when that time comes, we all deserve to know that our loved ones are safe and receiving the quality of care they deserve. Nursing homes have a major responsibility to protect their residents from all forms of abuse and neglect. Those who fail to do so deserve to be held accountable for their negligence.

The elderly are some of the most vulnerable members of our communities. Tragically, they are often targeted as victims of sexual abuse. There have been widespread reports of nursing home residents being sexually abused by staff members, fellow residents, visitors, and intruders. When this happens, it’s important to determine if the nursing home did all that they could to prevent the abuse.

In many cases of sexual abuse in nursing homes, the facility was negligent in their failure to prevent or stop the abuse. For example, a nursing home might be considered negligent for inadequate supervision that resulted in one resident sexually assaulting another. In cases of negligence, the victims and their families may have the right to file a lawsuit.

If you or a loved one has is a victim of nursing home sex abuse, you can learn more about your family’s legal rights by speaking with an experienced sex abuse victims attorney.
