Justice For Daycare Sex Abuse Victims and Their Families
Attorney contributor Brian Kent of AbuseGuardian.com represents sexual abuse victims and their families in lawsuits against sexual predators and negligent third parties that failed to stop the abuse. Here are a few thoughts from Brian on the legal options available to daycare sex abuse victims and their families:
Daycares and all other businesses where adults are responsible for looking after children have a critical legal duty to make sure these children are safe. Tragically, sexual predators are often found in fields that involve working with kids. Daycares must do everything they can to make sure these predators are not permitted to work or volunteer for them in any capacity and other preventative measures should also be in place to reduce the risk of sexual abuse as much as possible.
When sexual abuse by a daycare employee is reported, both the accused employee and the daycare should be investigated. The employee will be the subject of a criminal investigation by the police department, while the daycare should be the subject of a civil investigation to determine if negligence played a role in allowing the abuse to occur.
For example, a daycare could be considered negligent if they failed to run background checks or failed to have a plan in place for preventing abuse by employees.
In cases of negligence, the victims and their families may have grounds for a lawsuit.
