Legal Recourse for Victims of Sexual Assaults by Massage Therapists
Former sex crimes prosecutor Brian Kent is a founding partner of AbuseGuardian.com – a national team of sex abuse victims attorneys. Brian has represented numerous clients in sexual assault lawsuits against massage therapy businesses, including nationwide chain Massage Envy. He has offered to share some of his knowledge on the legal rights available to victims of sexual assault by massage therapists:
Massage therapy is a sensitive business and it’s important that massage therapists can be trusted by their clients. Unfortunately, this field has recently had widespread issues with sexual assault. When a customer reports being sexually assaulted by a massage therapist, both the accused employee and the business should be investigated.
In some cases of massage therapist sexual assault, the massage therapist’s employer is partially responsible for failing to prevent the assault because of negligence. For example, a massage therapy business owner might be considered negligent if other customers had reported inappropriate behavior by the employee, but no action was taken (such as firing that employee).
