Are Bar Owners Responsible for Shootings on Their Properties?
Attorney contributor Brian Kent of CrimeVictim.Attorney represents bar shooting victims and their families in civil cases, helping them secure the financial compensation they deserve for the damages they’ve suffered. Here are some of Brian’s thoughts on bar owner liability for shootings and other violent incidents:
Bar owners and all other types of property owners have a legal duty to make sure their properties are free of foreseeable dangers. This helps protect the safety of customers, employees, and all other visitors to a particular property. As part of this legal duty, property owners must keep their premises reasonably safe from the risk of foreseeable violent crime. When a bar owner fails to protect their property from such reasonably foreseeable violent crime and a shooting happens, the victims and their families may have grounds for a lawsuit.
For example, a bar owner might be considered negligent if their bar had a history of violent incidents, but no efforts to improve safety were made prior to the shooting – such as hiring security guards.
