When Can A Truck Accident Victim Sue?

Laurence Banville of Banville Law is an attorney contributor at the Legal Herald. He has spoken on the legal rights of truck accident victims who have been injured in a crash.

"When life-altering injuries are sustained in a crash, the victims of the crash typically have the legal right to file a civil lawsuit against the negligent parties. This negligent party isn't always the driver, it could be an mechanic shop that failed to make proper repairs or the company that owns the truck and failed to do proper maintanence.

A civil lawsuit can provide a plaintiff with the compensation that they need in order to pay for ongoing medical care and for any wages they will lose as a result. Many victims make the mistake of thinking that this compensation will come from an insurance claim, but sadly, insurance companies stop payment as soon as a policy limit is met. Depending on the limits, this could mean that after one surgery, a patient is left to fend for themselves.

Taking legal action isn't a simple process which is why consulting an experienced attorney is necessary. Don't wait to call a law firm as evidence needs to be collected quickly."
